NOTICE OF BY-LAW REVIEW

Pursuant to section 249 of the Local Government Act 1999, notice is hereby given that at its meeting on 14 February 2017, the Council endorsed the proposed By-laws listed below for public consultation. Details regarding the nature and effect of the proposed By-laws are as follows:

  1. By-law No. 1 – Permits and Penalties 2017:
    A By-law to create a permit system for Council By-laws, to fix maximum and continuing penalties for offences, and to clarify the construction of Council By-laws.
  2. By-law No. 2 – Moveable Signs 2017:
    A By-law to set standards for moveable signs on roads and to provide conditions for the placement of such signs for the purpose of protecting visual amenity and public safety, whilst recognising the advertising needs of businesses to maximise economic viability.
  3. By-law No. 3 – Local Government Land 2017:
    A By-law to manage and regulate the access to and use of Local Government land (other than roads).
  4. By-law No. 4 – Roads 2017:
    A By-law to manage, control and regulate certain activities on roads in the Council’s area.
     
  5. By-law No. 5 – Dogs 2017:
    A By-law to limit the number of dogs kept on premises and for the management and control of dogs in the Council’s area.
  6. By-law No. 6 – Cats 2017:
    A By-law to limit the number of cats kept on premises and for the management and control of cats in the Council’s area, including in line with the Council’s position statementto eliminate feral cats from Kangaroo Island for conservation purposes and to protect Kangaroo Island’s biodiversity and ecosystems.
  7. By-law No. 7 – Keeping of Livestock  2017:
    A By-law to control the conditions for keeping livestock, fowl and bees within urban areas in the interests of the community and to limit the number of livestock and fowl kept in urban areas.
     
  8. By-law No. 8 – Foreshore & Boat Facilities 2017:
    A by-law for the management of foreshore areas and to regulate the use of boat facilities within the Council’s area, including on any foreshore or Local Government land.

Hard copy feedback forms can be mailed to Kangaroo Island Council PO Box 121, Kingscote SA 5223. Hard copies of the By-laws and feedback forms are available from Council's Customer Service Centre in Kingscote, and the Penneshaw Community Business Centre.

21 day consultation period closes 5.00pm, Friday 31 March 2017. 

Next Steps:

Following consultation, submissions will be collated and considered and By-Laws amended if required prior to being adopted by Council.


 

 

Street Numbering - Baudin Beach

As part of the Street Numbering for Townships & Coastal Settlements project, the proposed street numbers for Baudin Beach have now been developed.

  • Street numbers are assigned every 16 metres or per allotment (smaller of the 2)

Hard copies of this consultation will also available for public viewing at the Kangaroo Island Council office and the Penneshaw Community Business Centre.

Street Numbering - Vivonne Bay

As part of the Street Numbering for Townships & Coastal Settlements project, the proposed street numbers for Vivonne Bay have now been developed.

Naming of Island Beach Street

As part of the Street Numbering for Townships & Coastal Settlements project, it has been identified a street within the coastal settlement of Island Beach is currently not named and a street name is required for street numbering.  Council is now seeking suggestions for the naming of this road, shown in map below.

Cat 3 Notifications

Category 3 developments include those kinds of development not listed as either Category 1 or 2 in Schedule 9 of the Development Regulations 2008. In this case, a public notice is placed in the newspaper and any person can make a representation on the application. Persons who make representations in relation to a Category 3 development can be heard if they request it as part of the submission. A representation to a Category 3 publicly notified proposal also has an appeal right against the decision

The application details (plans, submissions etc) can only be viewed at Council's Office. Should you wish to obtain copies of these documents and a fee is also payable.

Please note that Category 3 Notifications are deleted from the website after the closing date.
