Kangaroo Island Council advise the following matters are currently out for public consultation.

Notice is hereby given that the Kangaroo Island Council (the Council), pursuant to Section 194 of the Local Government Act 1999, has resolved to commence a process to revoke the community land classification ofthe Kangaroo Island Waste Resource Recovery Centre land, North Coast Road, Kingscote (‘the Land’).

More specifically, the Land is described in Certificate of Title Volume 5611 Folio 656 and is:

  • Lots comprising pieces 4 and 5 in Filed Plan 103561 (noting Piece 4 is already revocated from its Community Land status)
  • Freehold land - fee simple; and
  • Owned by the Council.

Further detail regarding the proposal is contained in the Report that the Council has prepared pursuant to Section 194(2)(a) of the Local Government Act 1999. The Report addresses (amongst other things) the reasons for the revocation proposal, which in summary is to recognise the operational nature of the Land as a waste transfer station/waste management faciltiy, and the potential scope for development in an Industry Zone.

Hard copies of the report are available for public inspection between Thursday 29 June and Friday 28 July 2017 during normal office hours at the Council’s office located at 43 Dauncey Street, Kingscote, the Penneshaw Community Business Centre at 99 Middle Terrace, Penneshaw.


Interested parties are invited to make submissions regarding the proposal for the Council’s consideration before 5:00pm, Friday 28 July 2017.

Submissions can be made using the online form or in writing and addressed to the Chief Executive Officer, Kangaroo Island Council, PO Box 121, Kingscote, SA 5223.

Cat 3 Notifications

Category 3 developments include those kinds of development not listed as either Category 1 or 2 in Schedule 9 of the Development Regulations 2008. In this case, a public notice is placed in the newspaper and any person can make a representation on the application. Persons who make representations in relation to a Category 3 development can be heard if they request it as part of the submission. A representation to a Category 3 publicly notified proposal also has an appeal right against the decision

The application details (plans, submissions etc) can only be viewed at Council's Office. Should you wish to obtain copies of these documents and a fee is also payable.

Please note that Category 3 Notifications are deleted from the website after the closing date.
