Council seeking feedback on community land

Kangaroo Island Council is currently seeking the community's feedback on community-owned assets. Community Land Management Plans (CLMPs) shape the future use of community-owned land under the care and control of the Council.

More than 40 CLMPs have been subject to public consultation since 2019, with more than 20 completed in the last 12 months.

This week, four additional CMLPs are out for public consultation in the Council Matters column beginning Thursday 29 February and closing at 5.00 PM on Wednesday 20 March 2024. These include:

  • American River Remembrance Reserve and Camping Reserve Management Plan
  • Baudin Beach Boat Ramp and Foreshore Reserve Management Plan
  • Captain Morgan Park Management Plan
  • American River Northern Day Visitor Amenities and Beach/Foreshore Management Plan

"A CLMP sets out the details for management of its community land. Section 199 of the Local Government Act 1999 (LG Act) requires that a council must manage community land in accordance with any management plan for the relevant land," Kangaroo Island Council CEO Daryl Buckingham said.

"Any activity or use of Council land contemplated by the community-on-community land must be identified within the relevant management plan for the applicable parcel of land," he said.

"If the activity is not already identified, the CLMP needs to be reviewed and consulted with the community and then endorsed by Council before the land management plan can be amended."

"Council understands there is some confusion about the purpose of the CLMP consultation of Captain Morgan Park," he said.

"The purpose of the CLMP consultation of Captain Morgan Park is to gain feedback on the details listed in the plan and accompanying Data Sheet - not proposals by private parties for the future use of the land," he said.

The Captain Morgan Park draft CLMP outlines changes to the ownership, land description and proposals for land management.

“Historically it was agreed that the land was to be acquired by the Coast Protection Board, with a financial contribution of 20% by the District Council of Kingscote and placed under the care and control of that Council, Mr Buckingham said.

However, the financial interest of Council is not formally recognised on the Crown Record, he said.

Council is planning to update this information in the Captain Morgan Park Land Management Plan Data Sheet along with a proposal for 20% equitable interest of Council to be realised by subdivision to transfer the section of land with a telecommunications tower and helipad to Council ownership."
